The Immigrant Population in Louisiana

Currently, Louisiana is home to a small, yet growing immigrant population. Approximately 4 percent of Louisiana’s population is made up of immigrants. These immigrants make up an essential part of the labor force in Louisiana, accounting for approximately 23 percent of those residents working in fishing, farming, and forestry jobs. Immigrants in Louisiana make extensive and beneficial contributions as business owners, workers, neighbors, and taxpayers.

Immigration produces countless opportunities to aid companies that are suffering  challenges within the workplace, such as work shortages. Recent studies have found that immigration provides substantial labor benefits by reversing the negative effects of population deficits by adding significant skills and experiences.

The Immigration and Nationality Act (INA) was created and implemented in 1952. Over the years, the INA has been amended numerous times. Although the amendments to the INA can be helpful and contribute to a smoother flow of immigration, many of the rules and regulations can be hard to understand.

Our Baton Rouge immigration attorneys provide a full spectrum of immigration legal services for individuals, families, and companies. We can help answer hard questions about immigration laws and can help navigate the complex legal system. Our immigration attorneys work closely with our clients to understand their needs and the urgency of their situation. Immigration, as a whole, is a time-sensitive issue, and that is where we can help. Contact the lawyers at Rusty Messer & Associates today to discuss.

Immigration laws in the U.S. specify numerous different categories of nonimmigrant visas based on the nature of employment, the talents of the individual, the involvement of training, and/or the nationality of the individual. Removal And Deportation in Louisiana

A Notice to Appear (NTA) is given by the Department of Homeland Security to someone, who is not a citizen of the United States, because of an immigration violation. This can occur if the person was staying in the U.S. without lawful status, or if he or she violated their status.

A Notice to Appear signals the initiation of removal proceedings against the person receiving the notice. If an NTA is delivered, the receiver must appear in Immigration Court. This document will explain the allegations and immigration law charges being filed against the individual.

The Department of Homeland Security will file the NTA with the Immigration Court and when the Immigration Court receives the document, they will set a date that the individual must appear in court. During this time, the individual may or may not be taken into custody and detained. If the individual is detained, they may be eligible for a bond. Our attorneys at Rusty Messer & Associates have experience handling several types of removal defenses including:

  • Application for permanent residency or adjustment of status
  • Cancellation of Removal for Non LPRs (42b)
  • Cancellation of Removal for LPRs (42a)
  • Criminal and non-criminal waivers of conditions of inadmissibility
  • Asylum and withholding of removal
  • Requests for prosecutorial discretion
  • Requests for judicial discretion
  • Motions for administrative closure
  • VAWA and VAWA cancellation of removal
  • U Visas
  • Motions to terminate
  • Requests for voluntary departure

The NTA should always be read carefully to ensure no mistakes were made and to confirm that all allegations are understood fully. A clear understanding of the NTA is crucial if you want to apply for immigration relief.

Our Baton Rouge immigration lawyers can help you navigate the legal complexities of an NTA and assist in avoiding removal and deportation. If you or someone you love is in jeopardy of being removed or deported from the United States and are in need of a skilled and knowledgeable immigration attorney in Baton Rouge, Rusty Messer & Associates can help.

You Have The Right To An Immigration Attorney

Our immigration attorneys at Rusty Messer & Associates understand that being an immigrant or the relative of an immigrant can cause apprehension and anxiety. Although immigrants add a lot of value to the United States economy and society, with new laws it can be a more difficult process. One of the most important things to learn and remember is that you have the right to hire an attorney.

Any person who is subject to removal or deportation has this right, but unlike criminal cases where an attorney is appointed, if you can not pay for one, in deportation cases, the defendant must seek out and hire an attorney on their own. Unfortunately, in these cases, the defendant is not entitled to a government-paid representative.

Flat Fees For Many Services We Offer

Our immigration lawyers have decades of experience handling the most complex and complicated immigration cases in the state at a reasonable fee. Unlike many other immigration law firms in the state, we represent both employers and employees during the three complicated phases of processing for employment-related immigrant visas.

Going through the legal process of immigration or deportation can be emotional and exhausting. Our legal team is dedicated to providing trustworthy and reliable legal help during a frustrating and undoubtedly scary time.

We handle most cases on a flat-fee basis. This means there will be no surprises when it comes to cost. We work with our clients by offering monthly payment plans secured by debit or credit cards. This allows people to get the legal help they need, at a time that they need it most.

Why Hire A Baton Rouge Immigration Attorney

Our immigration attorneys play an important role in aiding and assisting immigrants in reuniting with family members, securing employment visas, and avoiding deportation. These are some ways in which Rusty Messer & Associates can help.

A study carried out in 2012 reported incredibly positive statistics regarding the impact of immigration attorneys. The following list illustrates some of the findings.

  • Legally represented immigrants in detention who had a custody hearing were four times more likely to be released
  • Legally represented immigrants were more likely to apply for relief from deportation
  • Detained immigrants with legal counsel were 11 times more likely to seek relief than those without representation
  • Detained immigrants with representation were twice as likely than unrepresented immigrants to obtain immigration relief

Sadly, a large number of immigrants that experience deportation proceedings have to do so without legal counsel. As the data shows, immigrants who were able to secure legal representation stood the best odds of obtaining relief.
