Business and real estate litigation often go hand in hand. For many businesses the largest asset is the real estate. However, there are several other types of real estate disputes that we are regularly hired to handle. Examples of some of the most common types are below.

How We Charge
We handle all business and real estate litigation on an hourly basis. We ask clients to place a deposit into trust and we bill against the deposit. The minimum deposit is $5,000 and may be higher depending on the size of the anticipated litigation. If the balance in the trust account falls below a set amount you will be asked to replenish the account. In our experience the average case cost runs between $20,000 – $50,000. However, the actual cost will depend on the facts of your case. We also have no control over what the other side does to run up costs. We do not handle business or real estate litigation on a contingency fee basis. All of our business and real estate litigation cases are handled on an hourly basis.

Why We Do Not Handle Litigation on a Contingency Fee

We find clients generally come out better paying us by the hour. If you have a collection case for $500,000 and we handle it on a contingency fee of 40%, our fee will be $200,000. It may take far less to actually get your case to trial and win a judgment in your favor. Often times clients have a contract that awards attorney fees. If the court awards attorney fees that award will belong to our client. We get paid for the actual time we spend working on the case.
What if my Business is Being Sued?

If your business is being sued, we may be in a position to represent you. It depends on what your business is being sued for. If what you are being sued for is covered by insurance, you should first report the claim to your insurance. If you’re being sued for some type of negligence claim, you probably fall into this category. There may other claims covered by insurance depending on what type of insurance you have. We are happy to discuss your case with you to help you determine if it should be first reported to your insurance company. Some insurance companies will also allow you to choose your own counsel and have the costs paid for under your policy.
