Immigration Lawyers in Louisiana
Our immigration attorneys at Rusty Messer & Associates offer a number of immigration legal services for individuals, families, and companies.
U.S. immigration laws allow foreigners to immigrate to the country based on a relationship with a U.S. citizen or permanent resident. Family-based immigration is split up into two categories.
- Immediate Relative Immigrant Visas – These visas can be applied for and awarded to immigrants who are married to a U.S. citizen, are an unmarried child of a U.S. citizen, are an orphan adopted abroad by a U.S. citizen, are an orphan to be adopted in the U.S. by a U.S. citizen, or they are a parent to an unmarried U.S. citizen.
- Family Preference Immigrant Visas – These visas can be applied for and awarded to immigrants with a more distant relationship with a U.S. citizen. Those who fall into this group include unmarried children of a U.S. citizen, spouses of legal permanent residents, married children of a U.S. citizen, or siblings of a U.S. citizen.
Immediate Relative Immigrant Visas have no cap on the number of immigrants that can be awarded visas in a single fiscal year. Unfortunately, the Family Preference Immigrant Visas are limited per each fiscal year.
It is for this reason that hiring an immigration lawyer can benefit immigrants who are trying to reunite with their families. The right legal representation can increase the odds of being awarded an immigrant visa.
Immigrant visas can also be allocated to immigrants who are looking to start a business in the U.S. or have been awarded employment by a U.S. employer. Business and employment visas fall into four different categories:
- Employment-Based Immigrant Visas – Under this visa, foreigners can permanently immigrate to the U.S. with an EB Visa if their U.S employer first obtains a labor certification approval from the Department of Labor and then files an Immigrant Petition for Alien Worker.
- Employment-Based Nonimmigrant Visas – These visas are allocated to those foreign nationals who are looking to work in the U.S. for a limited period of time. Generally, employment-based nonimmigrant visas are based on a U.S. employment offer.
- Investor Visas – These immigrant visas are made available to foreigners who are seeking to enter the U.S. to create a new commercial enterprise. To qualify for this visa, the immigrant must be able to invest a certain amount of money in a commercial enterprise.
- Program Electronic Review Management (PERM) – PERM is the system used for obtaining a Labor Certificate. PERM is also the first step for those immigrants seeking an employment-based immigration visa.
At Rusty Messer & Associates we offer our immigration law clients legal services for a reasonable flat fee. Clients will be informed of all costs beforehand so that no surprises occur.
We hande all aspects of deportation defense cases in immigration courts. The first step is usually to determine if the alien is eligble for an immigration bond. If a person is not eligble for an immigration bond, or the court does not grant a bond, we can help him or her determine what other type of removal defense to present. We have helped aliens with asylum cases, cancellation of removal, adjustment of status while in removal, appeals, and other forms of relief. We work with our clients and their families to develop their cases and help them present the best evidence on their behalf. We have handled cases in immigration courts in Louisiana, Tennessee, and Texas.
Temporary residence in the U.S. can be awarded to those foreigners who are seeking nonimmigrant visas. These visas can be utilized for business, personal, and emotional reasons. U.S. immigration laws allow for a number of different nonimmigrant visas, across a myriad of different categories. These categories are based on the nature of employment, the involvement of training, and the unique talents of the individual.

Have Any Questions To Ask?
Admission occurs when you are legally admitted to the US at a port of entry. To be admitted you have to be admissible to the US and there are certain criminal convictions that can make you inadmissible.
If you miss your criminal court appearance in Louisiana, the court will likely issue a warrant for your arrest. This is commonly called a bench warrant because it’s issued by the judge while sitting at his desk in the courtroom, which is also known as the “bench”. Missing court may also be called a “failure to appear” or “FTA” for short.
Local jails and District Attorneys often fail to comply with these deadlines which can unnecessarily delay your criminal case and can result in prolonged detention. While the law places the burden on the State to meet these deadlines, the defendant will usually need to be the one to let the court know if the State has missed one.
